The court appearance comes weeks after a Will County Grand Jury returned a sealed indictment against Bernal on December 9, 2025. That date marked exactly 37 years since Joan Bernal was last seen alive.

According to the Sheriff’s Office, Bernal was taken into custody at his residence in Flint, Michigan, on December 11, 2025. Members of the United States Marshals Service Great Lakes Regional Task Force executed the arrest based on re-opened leads. Bernal was held at the Genesee County Jail in Michigan pending extradition and arrived at the Will County Sheriff’s Office Adult Detention Facility on January 2, 2026.

The 1988 Disappearance
Joan Bernal was last seen on December 9, 1988. Investigators allege that a domestic violence incident occurred at the couple’s Joliet residence prior to a planned family trip to Texas. The dispute reportedly arose when Joan’s ex-husband refused to allow their shared children to accompany the couple on the trip.

Eyewitness testimony cited by authorities alleges that Gilbert Bernal began physically battering Joan inside the home and dragged her to the rear of the residence. This was the last time she was reported seen.

Gilbert Bernal reported his wife missing nearly three weeks later, on December 27, 1988. At the time, he told police he had left her at a bus stop in McAlester, Oklahoma. Despite decades of investigation, Joan Bernal’s body has never been found.

Renewed Investigation
The case was reinvigorated in recent years after the Will County Sheriff’s Office established a dedicated team of detectives focused on cold cases. These detectives re-examined evidence and interviewed witnesses, leading to the recent indictment.

The investigation also garnered national media attention earlier this year when it was featured on an episode of “Cold Justice” on the Oxygen Network. The episode highlighted the steps taken by local detectives and the show’s hosts to seek answers for the victim’s family.

During the January 5 hearing, the Grand Jury Bill of Indictment was unsealed. Officials stated that this legal step provides a measure of closure for Joan’s family.

“This long-awaited legal step honors Joan’s memory and underscores law enforcement’s commitment to never giving up on cold case investigations,” the Sheriff’s Office said in a statement.

Gilbert Bernal Sr. is scheduled to appear in court again on January 12, 2026, for a detention hearing.
